1. Agreement to These Terms
These Terms of Service and User Agreement (“Terms”) govern your access to and use of the Survyve mobile application, websites, services, subscriptions, content, software, and related features (collectively, “Survyve,” the “App,” or the “Service”).
The Service is provided by GBEC LLC (“Survyve,” “we,” “us,” or “our”). By creating an account, downloading the App, purchasing a subscription, tapping to accept these Terms, or using the Service, you agree to these Terms.
If you do not agree, do not use the Service.
2. Emergency and Safety Notice
Survyve is a preparedness, planning, coordination, and reference tool. Survyve is not an emergency service, dispatch service, rescue service, medical provider, public alert system, insurance product, security system, or substitute for official emergency communications.
In an emergency, call 911 or the applicable local emergency number, follow official evacuation orders and public safety instructions, and use your own judgment. The Service may be delayed, unavailable, inaccurate, incomplete, stale, or interrupted because of device failure, low battery, network outages, blocked permissions, GPS limitations, map limitations, third-party service failures, emergency conditions, or other causes outside our control.
You are solely responsible for decisions you make before, during, and after an emergency.
3. Eligibility
You must be at least 13 years old to create a Survyve account. If you are under the age of majority where you live, you may use the Service only with consent and supervision from a parent or legal guardian.
Survyve may allow adult account holders to create managed profiles for children, dependents, seniors, pets, or other people they care for. Managed profiles are not independent child accounts. If you enter information about another person, you represent that you have the right and permission to do so.
4. Accounts and Security
You may need an account to use some features. You agree to provide accurate information, keep your credentials secure, and promptly update account information when it changes.
You are responsible for activity under your account, including activity by household members or people you invite if that activity occurs through your account, device, invite codes, or shared links. Notify us promptly at hi@survyve.shop if you believe your account or household invite has been compromised.
We may suspend, restrict, or terminate accounts that violate these Terms, create risk, misuse the Service, or are required to be suspended by law, platform rule, or security concern.
5. What Survyve Provides
Depending on your device, location, permissions, account status, and subscription status, Survyve may provide features such as:
- Emergency preparedness checklists, guides, playbooks, and local references.
- SOS flashlight and visual signaling tools.
- Tactical breathing and crisis-mode utilities.
- Local briefings, emergency contact lists, and resource notes.
- Maps, location display, waypoints, breadcrumb trails, route-back framing, offline map pack metadata, threat overlays, and route-plan tools.
- Household coordination, invite codes, rally points, shared route plans, crisis updates, acknowledgements, and notification delivery status.
- Inventory, supply readiness, stock analytics, expiration reminders, barcode scanning, barcode enrichment, import/export, and review-gated photo-based supply suggestions.
- Local storage for important document images, profile images, household photos, and utility-location photos.
- Push notifications and local reminders where enabled and supported.
- Premium subscription access and household-sponsored Premium access.
Features may change over time. Some features may be unavailable on some platforms, devices, operating systems, countries, accounts, or builds.
6. Local-First and Offline Limitations
Survyve is designed to keep many records available on your device, but local-first does not mean risk-free. Local records can be lost if your device is lost, damaged, reset, out of storage, uninstalled, corrupted, or not backed up.
Some features require network access or server-side processing to sync, refresh, enrich, notify, or analyze data. Offline or cached information may be stale. You are responsible for reviewing timestamps, source labels, and local conditions before relying on any information.
7. Health, Medical, First Aid, Food, and Supply Information
Survyve may include first-aid references, emergency guides, water, food, medical, medication, supply, and readiness information. This information is for general preparedness and informational purposes only. It is not professional medical advice, diagnosis, treatment, nutrition advice, engineering advice, survival training, or emergency response advice.
Always consult qualified professionals where appropriate. For life-threatening or urgent medical situations, contact emergency services immediately.
Inventory calculations, expiration reminders, calories, water coverage, days-of-supply estimates, route-risk indicators, and readiness scores are estimates. You must verify your actual supplies, labels, expiration dates, storage conditions, medication instructions, water safety, household needs, and emergency plans.
8. AI, Barcode, Threat, and Resource Results
Some Survyve features may use third-party or automated systems to suggest inventory entries, interpret photos, enrich barcodes, identify nearby medical resources, or refresh threat information. These systems may rely on providers such as OpenAI, Open Food Facts, Google Places, National Weather Service data, USGS data, map providers, and other sources.
Automated and third-party results can be incomplete, incorrect, unavailable, outdated, or not appropriate for your situation. Photo-based supply suggestions require your review before saving. Barcode suggestions may not match the item you scanned. Threat, map, route, medical-resource, or public-source data may not reflect current conditions.
You are responsible for verifying all results before using them.
9. Location, Maps, Routes, and Movement
If you enable location features, Survyve may use your device location to show your position, create local briefings, save waypoints, record breadcrumb trails, review route context, display threat overlays, and support household coordination features.
Maps, routes, breadcrumbs, waypoints, route-risk summaries, offline maps, route plans, and threat overlays are planning aids only. They may be inaccurate or incomplete and may not account for road closures, private property, terrain, flooding, fire, crime, weather, construction, evacuation orders, restricted areas, accessibility needs, or real-time hazards.
Do not use Survyve while driving or moving in a way that distracts you or violates law. Follow official instructions, posted signs, and local conditions.
10. Household Features and Shared Content
Survyve may allow you to create or join a household, invite members, manage roles, create managed profiles, save rally points, share route plans, send crisis updates, acknowledge updates, track route-plan progress, coordinate inventory, and receive household notifications.
You are responsible for:
- Inviting only people you intend to invite.
- Keeping invite codes and links secure.
- Getting permission before entering or sharing another person’s information.
- Ensuring household, dependent, child, pet, medical, route, inventory, and crisis information is accurate and appropriate to share.
- Understanding that household members may see information shared with the household.
- Verifying that recipients actually received and understood critical information.
Survyve does not guarantee that household messages, route alerts, crisis pings, prompts, receipts, acknowledgements, push notifications, SMS messages, emails, share links, or invite codes will be delivered, seen, opened, imported, acknowledged, or acted upon.
11. User Content
“User Content” means information, text, photos, images, routes, locations, profiles, notes, documents, inventory records, crisis updates, invite labels, household data, and other materials that you submit, store, generate, upload, share, import, or sync through the Service.
You retain ownership of your User Content, subject to the rights you grant in these Terms. You grant Survyve a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, display, adapt, and use your User Content as necessary to provide, maintain, secure, troubleshoot, improve, and support the Service and as otherwise described in our Privacy Policy.
You represent that you have all rights and permissions needed to provide your User Content and that your User Content does not violate law, infringe rights, endanger others, or violate these Terms.
12. Important Documents and Sensitive Information
Survyve may let you store images of IDs, passports, insurance cards, medical information, emergency contacts, and other important documents on your device. You are responsible for deciding what to store and for protecting your device with appropriate security controls.
Do not store or share information through Survyve unless you understand the risks. If you choose to include sensitive information about another person, you must have permission and a lawful basis to do so.
13. Permissions and Device Features
Survyve may request access to device features such as location, camera, photo library, contacts, notifications, phone links, SMS, email, share sheet, clipboard, file storage, haptics, and flashlight/torch. You can deny or revoke permissions through your device settings, but some features may stop working.
Contacts access is used only when you choose to invite people from your contacts. SMS, email, share sheet, and clipboard actions depend on your device, carrier, operating system, and third-party apps.
14. Notifications
Survyve may send or schedule local reminders and remote push notifications for crisis updates, shared routes, route follow-ups, threat changes, inventory expirations, household follow-ups, and related features if you enable them.
Notifications are not guaranteed. They may be delayed, suppressed, blocked by permissions, quiet hours, snooze settings, focus modes, platform policies, network conditions, or provider failures. Do not rely on notifications as your only emergency communication method.
15. Subscriptions, Trials, Billing, and Cancellation
Survyve may offer paid subscriptions, including Survyve Premium. Subscription features, prices, trial periods, billing intervals, and availability may vary by platform, country, offer, or store.
Survyve currently offers monthly and annual Survyve Premium plans and a 3-day free trial where available. Your purchase screen will show the applicable price, billing period, trial, and renewal details before you confirm a purchase.
Subscriptions purchased through the Apple App Store or Google Play are billed by the applicable app store. They automatically renew unless cancelled before the end of the current billing period or trial period according to the store’s rules. You can manage or cancel app-store subscriptions through your Apple App Store or Google Play account settings.
Refunds, billing disputes, payment methods, price changes, taxes, and cancellation timing for app-store purchases are generally handled by the applicable app store and subject to that store’s terms and policies. We do not control Apple or Google billing systems.
If Survyve offers household-sponsored Premium access, a household lead or sponsor may cover access for other household members. If the sponsor’s subscription expires, is cancelled, is refunded, or is otherwise inactive, sponsored access may end. Non-sponsor household members may need to ask the household lead to renew or may need to leave the household context to purchase personal access.
16. Acceptable Use
You agree not to:
- Use the Service for illegal, harmful, abusive, deceptive, harassing, or unsafe purposes.
- Interfere with emergency responders, public safety operations, official alerts, or lawful orders.
- Share false emergency information, fake crisis pings, misleading route information, or fraudulent invite links.
- Enter information about another person without permission.
- Upload or share content that infringes rights, violates privacy, exposes sensitive data without authorization, or endangers others.
- Attempt to access another user’s account, household, device, data, invite code, or subscription without authorization.
- Reverse engineer, modify, disrupt, scrape, overload, or attack the Service except where allowed by law.
- Circumvent subscription, entitlement, security, sync, or platform controls.
- Use the Service to build a competing product or train models without our written permission.
17. Our Content and License to You
Survyve and its software, designs, trademarks, logos, content, guides, playbooks, checklists, code, interfaces, and other materials are owned by us or our licensors and are protected by intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to install and use the App on devices you own or control for personal, household, and non-commercial preparedness purposes.
You may not copy, sell, rent, lease, sublicense, distribute, modify, create derivative works from, reverse engineer, or otherwise exploit the Service except as allowed by these Terms, applicable law, or open-source licenses that apply to included components.
18. Feedback
If you send us feedback, ideas, suggestions, or bug reports, you grant us the right to use them without restriction or compensation to you.
19. Third-Party Services
The Service may rely on or link to third-party services, platforms, stores, APIs, data sources, maps, authentication providers, payment providers, AI providers, push notification systems, device services, and communication tools. These third parties are not controlled by us and may have their own terms, privacy policies, fees, outages, limitations, and data practices.
We are not responsible for third-party services, third-party content, third-party billing, public-source data, carrier services, mail apps, SMS apps, app stores, map providers, authentication providers, or AI providers.
20. Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect information. By using the Service, you also agree to the Privacy Policy.
Privacy Policy: survyve.app/privacy
If these Terms conflict with the Privacy Policy on a privacy-specific issue, the Privacy Policy controls for that issue.
21. Updates and Changes to the Service
We may update, modify, suspend, limit, or discontinue any part of the Service at any time. Updates may be required for security, compatibility, legal compliance, platform compliance, bug fixes, subscription management, or new features.
We are not required to provide any particular feature, content, data source, offline capability, sync path, or integration indefinitely.
22. Termination
You may stop using the Service at any time. You may cancel paid subscriptions through the app store account where you purchased them.
To request account deletion or data assistance, contact hi@survyve.shop or use any in-app deletion flow we make available.
We may suspend or terminate your access to the Service if you violate these Terms, create legal or safety risk, misuse the Service, fail to pay required fees, infringe rights, or if required by law, platform policy, or security concern.
Termination may not automatically delete local data stored on your device, household data shared with other members, app-store billing records, backup copies, legal records, or records we must retain for legitimate business, legal, security, or compliance reasons.
23. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory.
We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, emergency suitability, uninterrupted operation, data preservation, and error-free operation.
We do not warrant that:
- The Service will work during an emergency.
- The Service will contact emergency services.
- The Service will prevent injury, death, loss, damage, or property damage.
- Maps, routes, threat data, medical resources, barcode data, AI results, inventory estimates, notifications, or local briefings will be accurate, current, complete, or available.
- User Content will be secure from every possible unauthorized access, loss, or corruption.
- Household members will receive, review, acknowledge, import, follow, or act on shared information.
Some jurisdictions do not allow certain warranty disclaimers, so some disclaimers may not apply to you.
24. Limitation of Liability
To the maximum extent permitted by law, Survyve and its owners, officers, directors, employees, contractors, affiliates, licensors, service providers, and agents will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, or for lost profits, lost revenues, lost data, loss of goodwill, personal injury, death, property damage, emergency response failures, missed alerts, missed routes, supply errors, device failures, or service interruptions, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total liability for all claims relating to the Service or these Terms will not exceed the greater of: (a) the amount you paid to Survyve for the Service in the 12 months before the event giving rise to the claim; or (b) USD $100.
The limitations in this section apply to any theory of liability, including contract, tort, negligence, strict liability, warranty, statute, or otherwise. Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.
25. Indemnity
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Survyve and its owners, officers, directors, employees, contractors, affiliates, licensors, service providers, and agents from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- Your use or misuse of the Service.
- Your User Content.
- Your violation of these Terms.
- Your violation of law or third-party rights.
- Information you enter, share, or sync about another person.
- Household invitations, household coordination, crisis updates, route plans, or inventory records you create or share.
26. App Store Terms
If you downloaded Survyve from the Apple App Store or Google Play, your use of the App is also subject to the applicable app store terms and policies. If these Terms conflict with the applicable app store terms in a way that cannot be reconciled, the app store terms control only to the extent required by that conflict.
Apple-Specific Terms
This section applies if you download or use the App on an Apple device.
- These Terms are between you and Survyve, not Apple. Apple is not responsible for the App or its content.
- The license granted to you is limited to a non-transferable license to use the App on Apple-branded products that you own or control and as permitted by Apple’s Usage Rules.
- Survyve, not Apple, is responsible for providing maintenance and support for the App, if any. Apple has no obligation to provide maintenance or support services for the App.
- If the App fails to conform to any applicable warranty that has not been disclaimed, you may notify Apple, and Apple may refund the purchase price for the App, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
- Survyve, not Apple, is responsible for addressing claims relating to the App or your possession and use of the App, including product liability claims, legal or regulatory claims, consumer protection claims, privacy claims, or intellectual property claims, subject to these Terms.
- You represent that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country and that you are not listed on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it against you.
27. Export and Sanctions Compliance
You may not use, export, re-export, import, sell, or transfer the Service except as permitted by applicable law, including U.S. export control and sanctions laws. You represent that you are not prohibited from using the Service under applicable sanctions or export control laws.
28. Governing Law and Disputes
These Terms are governed by the laws of the United States and of the state in which GBEC LLC is organized, excluding conflict-of-law rules, except where the law of your place of residence requires otherwise.
The state and federal courts located in that state will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service, except where applicable law requires a different forum. Each party consents to the jurisdiction of those courts.
29. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide notice through the App, by email, by posting an updated version, or by another reasonable method. The updated Terms will be effective when posted or as stated in the notice.
Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
30. Miscellaneous
These Terms, together with the Privacy Policy and any additional terms presented for specific features or purchases, are the entire agreement between you and Survyve for the Service.
If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, financing, corporate reorganization, sale of assets, or by operation of law.
